MINUTES- PLANNING COMMISSION

ORDER OF BUSINESS

I.) CALL MEETING TO ORDER – The meeting was called to order at 7:00 pm.

II.) PLEDGE OF ALLEGIANCE – Recited.

III.) ROLL CALL: Mr. Miller, Mr. Collins, Ms. Montgomery and Mr. Shreiber were all present. Mr. Perry was absent. A motion was made by Mr. Shreiber to excuse Mr. Perry, second by Ms. Montgomery. Motion passed by a unanimous vote. Also present was new City Attorney James Sherron, Public Works Director Rob Leichman and Zoning Administrator Bill Jones.

IV.) APPROVAL OF MINUTES OF PREVIOUS MEETING: A motion to approve the minutes of the March 13, 2017 meeting was made by Mr. Collins, second by Ms. Montgomery. The motion passed by a unanimous vote, Mr. Schreiber abstained.

V.) NEW BUSINESS:
1. Magnode Expansion Project.
a. Presentation by Mark Butterfield, Vice-President Engineering-Manufacturing at Magnode. Mr. Butterfield thanked everyone for allowing him to be here. Magnode is a family owned businesses that was is founded here in Trenton along with a facility in Indianapolis. They have four generations involved in the business and about 2% of family owned businesses don’t last this long. They have been planning since 2015 to replace a 1957 extrusion press. They were able to purchase land from a neighbor in order to put in the new building. The press parts are coming from vendors locally, in Michigan and the press is coming from Japan. The building is about 43,000 SF and the new press is about 60% faster than the old press. The building was designed in order for possible future expansion. Magnode has about 70% of its business in the automotive industry and compete with the larger companies but they do high detail parts which a lot of companies do not want to do. The rest of their business is in building construction materials and consumer electronics. Magnode does work for 5-6 pieces a quarter up to some programs that are 50-60 thousand pieces a week. They do plan to hire engineering and shop personnel, possibly about 30 jobs, some of which will be pulled from Indianapolis. They have new positions for robotics as well. They have about 220 employees between Trenton and Indianapolis.

b. Exhibit A: Approval by Kleingers
Mr. Jones explained that this project has been examined by City Staff, City Engineers, Magnode Staff and their contractors. He explained that Exhibit A and Exhibit A-1 is the same thing except A-1 has a small difference where the water was to be located in the new building. A review was done, very extensive and not all of that was included in the Planning Commission meeting. Everything has been accepted and Mr. Jones requested that the Planning Commission accept the proposal as presented.

A motion was made by Ms. Montgomery to approve the plans as presented, second by Mr. Collins. The motion passed by a unanimous vote.

2. AN ORDINANCE AMENDING CHAPTER 1252 CONVENTIONAL ZONING DISTRICTS AND REGULATIONS, OF THE CODIFIED ORDINANCES OF THE CITY OF TRENTON, OHIO, TO ALTER THEIR FORMAT AND AMEND THE MINIMUM SQUARE FOOTAGE REQUIREMENTS FOR SINGLE FAMILY DWELLINGS.

a. Exhibit B – Proposed ordinance
Mr. Jones explained that the original ordinance (exhibit B) has already had a first reading in Council. The purpose of this ordinance to raise the minimum square footage for new homes. R-2 homes are the main housing areas that we have and found out that by raising the minimum from 1,200 SF to a minimum 1,600 SF would place about 60-65% of our housing stock into a legal non-conforming status.
b. Exhibit C – City Code-Non-conforming
Much discussion was had on what a non-conforming lot or house is. Mr. Jones explained that a lot is required to be a minimum size, width and/or depth. At the time the older stock was built, the lots were legal at one point but since the code has been changed, the lots may not meet the minimums required today placing them into a legal non-conforming status. Homes can be the same way as the lots. At one point when built, they were legal but now they are not because again, we changed the rules. It is not good to have 60-65% of your housing stock placed into legal non-conforming status. A legal non-conforming house, if destroyed, may not be able to be built back or it may need to be expanded. By passing the original proposed ordinance, we would be negatively affecting a lot of houses in Trenton.
c. Exhibit D – Percentages of R-2 becoming Legal Non-Conforming
This exhibit shows a brief survey of houses on a collection of streets how many houses are on the street, how many currently are greater than the proposed 1,600 SF and how many homes if changed would be under 1,600 SF and the percentage. This is where the 60-65 % numbers came from.
d. Exhibit E – Updated proposed ordinance
The original ordinance was amended through the help of our Zoning Consultant Roger Eckert and language was added to make sure that only new houses built after the passage of this ordinance would be required to be a minimum new square feet. If, after the passage of this ordinance, a current resident is already non-conforming, it will still be non-conforming. Same thing as a house that currently it a legal home, it will still be a legal home after the passage of this ordinance. A lot of discussion was made to understand that this new amended ordinance (exhibit E) would not affect existing homes, only newly built homes.

After all the discussions, Ms. Montgomery made a motion to recommend exhibit E as the new ordinance to pass, second by Mr. Collins. The motion passed by a unanimous vote.

VI.) REPORTS BY COMMISSION OR CITY ADMINISTRATORS
Mr. Jones congratulated Mr. Sherron for being our new City Attorney.

Mr. Leichman thanked the Magnode Corporation for allowing his staff to inspect their property as far as all the existing and abandoned utilities which was needed to be able to put in the new building. He thanked the Bidwell family and Mark Butterfield for being such a good company to deal with.

Mr. Sherron expressed that he was glad to be a part of the City.

Ms. Montgomery welcomed Mr. Sherron as well.

VII.) DATE OF NEXT MEETING – May 8, 2017 if needed.
Mr. Jones reported that as long as Council refers a new ordinance in their April 20, 2017 meeting to the Planning Commission, we will be having a meeting on the 8th to discuss a new ordinance about civil penalties. This is an ordinance to levy fines on land owners who repeatedly violate the City code.

VIII.) ADJOURNMENT
Mr. Collins made a motion to adjourn, Ms. Montgomery second. The motion passed by a unanimous vote. The meeting was adjourned at 8:35 pm.
